La decisión

El oficial de audiencia debe:

• Toma una decisión basada en pruebas claras y convincentes
• Explica la decisión empleando hechos y las normativas y políticas aplicables
• Redacta un reporte que incluya:
• What was found
• What was decided
• Why the decision was made
• Any recommendations

La decisión también debe:

• Say why the person was found guilty or not
• Enumera las pruebas y reglas empleadas
• Respond to any strong arguments made by the person or their representative

Getting the Decision

El oficial de audiencia deberá:

• Send the decision in writing
• Tell the person they can appeal the decision in circuit court

If the person is found guilty, the letter will say they will be disqualified from getting benefits.

If the person is found not guilty, the person may still have to pay back the extra benefits that they received.

Can the Decision Be Changed?

• No hay otra apelación a través de la agencia luego de la audiencia.
• The decision cannot be changed by another agency hearing.
• La persona aún puede acudir al tribunal de circuito para intentar cambiar la decisión.
